Marie Claire reports: In the Aude, a father indicted for incestuous sexual assault on his child obtains his custody.
A judge in Aude has granted visitation and accommodation rights to the father of a child. However, the latter accuses this parent of sexual violence. The mother, who filed a complaint for her son, can only see him today under the supervision of child welfare.
Journalist Sarah Brethes conducted the investigation to Mediapart.
In an article published on January 17, 2023, the investigation site reveals that an Aude judge granted on appeal, on December 22, 2022, a right of visit and accommodation (one weekend out of two and during school holidays) to the father of an 8-year-old boy, indicted on July 4 for “incestuous sexual assault” on the child.
As for the mother, she now has the right to see her son for two hours every two weeks, in a neutral place and under the supervision of child welfare, details Mediapartwhich traces precisely and chronologically the twists and turns of this affair.
“Rape and incestuous sexual assault”
In October 2020, this woman filed a complaint for rape and incestuous sexual assault following – according to her testimony – revelations from her son, of whom she then had custody.
During the preliminary investigation opened by the parquet floor of Narbonne (Aude), the boy supports his declarations and the psychological expertise does not find “no element allowing to doubt the credibility of the child”.
The investigation is dismissed by the prosecution for “insufficiently characterized offense” on January 12, 2021.
In the summer of 2021, when a family affairs judge ruled for an alternating residence for the child, the mother files a new complaint with a civil action. A judicial inquiry is open.
The boy is placed in foster care to protect him from the conflicts between his two parents.
Suspicion against the mother, custody for the father
A year later, in the summer of 2022, the family court judge suspects the mother of manipulating the child.
